You can't blame them. They had put a lot of $ in this game and got nothin. EA has the rights for the game now, but Double fine didn't make the game in time so Activision has the right to process.

Activision didn't put squat into the game. They dropped Brutal Legend, meaning the rights to the game were up for grabs. EA saw their chance and jumped in. I heard someone else give a good analogy. "It's like divorcing your wife because she isn't beautiful enough for you, and then suing her once she's found a better man."
